SUMMARY
This workshop will increase your understanding of ESI issues
and enable you to plan appropriately. Proper preparation helps
reduce the burden on local government that must respond to
discovery requests involving ESI, reducing costs to local
government in manpower, insurance premiums, and sanctions.

LEARNING OBJECTIVES
Unfortunately, federal lawsuits against local government
related to employment issues, civil rights, Title IX and other
federal laws are becoming more common. Recent amendments
to the Federal Rules of Civil Procedure concerning the discovery
of Electronically Stored Information (ESI) will increase the
burden on local government to preserve and disclose such information.
Many recent court decisions have saddled responding parties,
such as local governments, with the cost of reproducing materials
from their technology systems, regardless of age, cost, utility,
or relevance.
More often than not, critical decisions affecting the existence,
preservation, and retention of key information are made well
before the filing and service of a lawsuit. In these situations, a
little preparedness goes a long way.
The workshop will discuss:
- What is ESI?
- What is E-Discovery?
- Penalties for unpreparedness and ignorance of
E-Discovery/ESI issues.
How to be prepared:
- Developing an E-Discovery Action Plan
- Enacting and Auditing Retention Policies
- Understanding and anticipating preservation or the
"Legal Hold"
Getting informed is the best way to meet this challenging issue,
which is growing in frequency and complexity.

SPEAKERS
John J. Radshaw III, JD
Attorney at Law
Mr. Radshaw is a partner at the law
firm of Howd & Ludorf, LLC in Hartford. He
represents CIRMA members throughout the
State of Connecticut in both state and federal
courts.
Mr. Radshaw concentrates his practice on the defense of public
officials accused of constitutional misconduct. He has defended
police officers, zoning officials, and other municipal employees on
a wide variety of issues ranging from excessive force, false arrest,
death in custody, unlawful retaliation, discriminatory conduct,
free speech, anti-trust and a number of other complex issues. Mr.
Radshaw has appeared before the United States Court of Appeals
for the Second Circuit and the Connecticut Supreme Court.
Mr. Radshaw is a graduate of Mary Washington College (B.A.,
1993) and he earned his law degree from Quinnipiac College School
of Law (J.D., cum laude, 1998). Mr. Radshaw is a Connecticut native
and resides with his wife in North Haven, Connecticut.

DIRECTIONS
From HARTFORD: Take Route 2 East to Exit 18. At the end of
the Exit 18 ramp, turn right onto Route 16 and continue to the
center of town. At the traffic light, turn left onto Norwich Avenue.
The Town Hall is approximately 1/4 mile up Norwich Avenue on left.
From MIDDLETOWN: Take Route 66 East to Route 16 East.
Follow Route 16 East to the center of town. At the traffic light, turn
right onto Route 85 East. At the first light, turn left onto Norwich
Avenue. Town Hall is approximately 1/4 mile up Norwich Avenue
on the left.
From NORWICH: From Route 2 West, take Exit 21 - Colchester
Business District. At the end of the Exit 21 ramp, turn left onto
Norwich Avenue. Continue on Norwich Avenue for 2+ miles, past
Bacon Academy High School on your right, then William Johnson
Middle School on the left. Continue 1/10th of a mile; at the base
of the hill, Town Hall is on the right.
